By accessing or using the Notary Helper website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Use (“Terms”). These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Notary Helper Inc., a company domiciled in the United States of America, with a regional office in Ireland serving the European Union (“Notary Helper,” “we,” “us,” or “our”).
If you do not agree to these Terms, you must immediately discontinue use of the Platform. Your continued use of the Platform following any updates to these Terms constitutes your acceptance of the revised Terms.
Notary Helper is an online platform that connects individuals and businesses (“Users”) with licensed notary lawyers and notarial service providers (“Notaries”) located around the world. The Platform also facilitates online notarization where legally permissible in the applicable jurisdiction.
Notary Helper acts as an intermediary and technology facilitator. We do not ourselves provide notarial, legal, or advisory services of any kind, and no attorney-client or notary-client relationship is formed between you and Notary Helper by virtue of your use of the Platform.
The Platform includes, but is not limited to, the following features:
To use the Platform, you must:
(a) Be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater;
(b) Have the legal capacity to enter into a binding contract;
(c) Not be prohibited from using the Platform under any applicable law; and
(d) Provide accurate, complete, and current registration information.
Where you are registering on behalf of a business or legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to “you” shall include that entity.
4.1 Account Creation. To access certain features of the Platform, you are required to register for an account. You agree to provide accurate, current, and complete information during registration and to keep such information updated at all times.
4.2 Account Security. You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at info@notaryhelper.com if you suspect any unauthorized access to or use of your account.
4.3 Account Responsibility. You are responsible for all activities that occur under your account, whether or not authorized by you. Notary Helper shall not be liable for any loss or damage arising from unauthorized use of your account where you have failed to maintain reasonable security over your credentials.
4.4 Account Suspension or Termination. We reserve the right to suspend or terminate your account at our sole discretion, including for violation of these Terms, fraudulent activity, or conduct harmful to other Users or Notaries, with or without prior notice.
You agree not to use the Platform for any purpose that is unlawful, prohibited by these Terms, or otherwise harmful to Notary Helper, its Users, Notaries, or third parties. Specifically, you agree not to:
(a) Submit false, misleading, or fraudulent information, including falsified identity documents;
(b) Impersonate any person, entity, or Notary;
(c) Attempt to gain unauthorized access to any part of the Platform or its underlying systems;
(d) Upload or transmit viruses, malware, or any other harmful code or files;
(e) Engage in any conduct that interferes with or disrupts the integrity or performance of the Platform;
(f) Use the Platform to solicit, harass, defame, or otherwise harm any person;
(g) Use automated bots, scrapers, or similar tools to access the Platform without our express written consent;
(h) Use the Platform in connection with any transaction that is fraudulent, illegal, or that involves forged, altered, or misrepresented documents; or
(i) Use the Platform in any manner that violates applicable local, national, or international laws or regulations.
6.1 Facilitation Only. Where Notary Helper facilitates online notarization, we provide the technology infrastructure to connect you with a Notary and support the remote notarization session. The notarization itself is performed solely by the independent Notary, not by Notary Helper.
6.2 Jurisdictional Compliance. Online notarization is not legally recognized in all jurisdictions. You are solely responsible for determining whether online notarization is valid and legally acceptable in the jurisdiction where the notarized document will be used. Notary Helper makes no representation or warranty regarding the legal acceptability of any online notarization in any specific jurisdiction.
6.3 Identity Verification. You agree to submit to any identity verification procedures required by the Platform or the Notary as a condition of online notarization. Providing false identity information during a notarization session is a serious legal offense and may result in immediate account termination and referral to law enforcement authorities.
6.4 Technical Requirements. You are responsible for ensuring that you have a compatible device, stable internet connection, and any other technical requirements necessary to participate in an online notarization session. Notary Helper is not liable for failed or incomplete notarizations resulting from technical failures on your end.
6.5 Session Recording. Online notarization sessions may be recorded in accordance with applicable laws and our Privacy Policy. By proceeding with an online notarization session, you consent to such recording.
7.1 Independent Professionals. Notaries listed on the Platform are independent professionals and are not employees, agents, or representatives of Notary Helper. We do not control, direct, or supervise the professional services rendered by any Notary.
7.2 No Endorsement. The listing of a Notary on the Platform does not constitute an endorsement, recommendation, or guarantee of that Notary’s qualifications, competence, licensure, or fitness for any particular purpose.
7.3 User Responsibility. You are encouraged to verify the credentials and qualifications of any Notary you engage through the Platform. While Notary Helper undertakes reasonable steps to vet Notaries registered on the Platform, we make no warranties regarding the accuracy or completeness of any Notary profile.
7.4 Third-Party Links. The Platform may contain links to third-party websites or services. Notary Helper is not responsible for the content, privacy practices, or availability of any such third-party platforms.
8.1 Per-Transaction Fees. Notary Helper charges a per-transaction or per-connection fee for facilitating connections between Users and Notaries and for enabling online notarization sessions through the Platform. The applicable fee will be clearly displayed to you before you confirm any transaction or booking. By confirming a transaction, you agree to pay the stated fee.
8.2 Notary Fees. Fees charged by individual Notaries for their professional services are set independently by those Notaries and are entirely separate from the fees charged by Notary Helper. You are solely responsible for agreeing to and paying Notary fees directly as arranged with the relevant Notary.
8.3 Payment Processing. All payments of Platform fees are processed through third-party payment processors. By making a payment, you agree to the terms and conditions of the applicable payment processor. Notary Helper does not store your full payment card details.
8.4 Currency and Taxes. Fees may be displayed in USD or other applicable currencies. You are solely responsible for all applicable taxes, duties, levies, or charges arising from any transactions conducted through the Platform.
8.5 Fee Changes. Notary Helper reserves the right to modify its transaction fees at any time. Changes to fees will be communicated to you prior to their taking effect and will apply only to transactions initiated after the effective date of the change.
9.1 Ownership. All content on the Platform, including but not limited to text, graphics, logos, icons, software, and the overall compilation thereof, is the property of Notary Helper or its licensors and is protected by applicable intellectual property laws.
9.2 Limited License. Notary Helper grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal or internal business purposes, in strict accordance with these Terms.
9.3 Restrictions. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, or transmit any content from the Platform without our prior written consent.
9.4 User Content. By submitting any content to the Platform (including documents, communications, or profile information), you grant Notary Helper a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely to the extent necessary to provide the Platform’s services to you.
Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your personal data as described in our Privacy Policy.
For Users located in the European Union or European Economic Area, Notary Helper’s EU regional office in Ireland acts as the data controller for the purposes of the General Data Protection Regulation (GDPR). Any data protection inquiries may be directed to info@notaryhelper.com.
11.1 No Legal Advice. Nothing on the Platform constitutes legal advice. Notary Helper is not a law firm and does not provide legal services. The information provided on the Platform is for general informational purposes only.
11.2 Platform Availability. The Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components.
11.3 Accuracy of Information. While we take reasonable steps to keep information on the Platform accurate and current, we make no warranties regarding the accuracy, completeness, or timeliness of any content on the Platform, including Notary profiles.
11.4 Jurisdictional Compliance. Notarial requirements and procedures vary significantly across jurisdictions. It is your sole responsibility to confirm that any notarization obtained through the Platform satisfies the legal requirements of the jurisdiction in which the notarized document will be used. Notary Helper accepts no liability for any failure of a notarization to meet the requirements of a particular jurisdiction.
To the fullest extent permitted by applicable law:
(a) Notary Helper shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, any online notarization session, or the services of any Notary accessed through the Platform;
(b) Notary Helper’s total aggregate liability to you for any claim arising under or related to these Terms shall not exceed the greater of (i) the total Platform fees paid by you to Notary Helper in the twelve (12) months preceding the claim, or (ii) USD $100;
(c) Notary Helper shall not be liable for any loss or damage resulting from the rejection of a notarized document by any authority, court, institution, or jurisdiction; and
(d) These limitations apply regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, or otherwise, and even if Notary Helper has been advised of the possibility of such damages.
Some jurisdictions do not permit the exclusion or limitation of certain categories of damages. In such jurisdictions, the above limitations shall apply to the maximum extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless Notary Helper, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
(a) Your use of the Platform or any online notarization session;
(b) Your breach of these Terms;
(c) Your violation of any applicable law or regulation;
(d) Any content or documents you submit to the Platform;
(e) Any misrepresentation of your identity or the nature of a document during a notarization; or
(f) Any dispute between you and a Notary.
14.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
14.2 EU Users. For Users located in the European Union, nothing in these Terms shall limit or exclude the rights available to you under the mandatory consumer protection laws of your country of residence.
14.3 Dispute Resolution. Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall first be submitted to good-faith negotiation between the parties. If the dispute is not resolved within 30 days of written notice, it shall be submitted to binding arbitration conducted in English under the rules of the American Arbitration Association (AAA).
14.4 EU Dispute Resolution. Users based in the European Union may also submit complaints through the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14.5 Class Action Waiver. To the extent permitted by applicable law, you waive any right to bring or participate in any class action lawsuit or class-wide arbitration against Notary Helper.
15.1 Platform Changes. Notary Helper reserves the right to modify, suspend, or discontinue the Platform or any part thereof at any time, with or without notice, and shall not be liable to you or any third party for doing so.
15.2 Changes to Terms. We may update these Terms from time to time. Where changes are material, we will notify you by email or by posting a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
Either party may terminate the relationship governed by these Terms at any time. You may terminate by ceasing to use the Platform and deleting your account. We may suspend or terminate your access immediately, without prior notice or liability, for any reason including your breach of these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and indemnification — shall remain in full force and effect.
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Notary Helper with respect to the Platform and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral.

20.1 Scope. This Refund Policy applies exclusively to per-transaction and per-connection fees charged by Notary Helper directly. It does not apply to fees paid directly to Notaries for their professional services.
20.2 Eligibility for Refund. You may request a refund of a Platform transaction fee within 14 days of the date of payment, provided that:
(a) The connection or online notarization session was not initiated or completed; or
(b) The session failed entirely due to a verified technical error on Notary Helper’s platform, and no alternative session was offered or completed.
20.3 Non-Refundable Circumstances. No refund will be issued where:
(a) The connection was successfully made and the notarization session was initiated, regardless of the outcome of the session itself;
(b) The refund request is submitted more than 14 days after the date of payment;
(c) The session failure was caused by your equipment, internet connection, or failure to meet technical requirements;
(d) The notarized document was subsequently rejected by a third party, authority, or jurisdiction;
(e) Your account has been suspended or terminated due to a breach of these Terms; or
(f) The fees relate to amounts paid directly to a Notary (see Section 20.5 below).
20.4 How to Request a Refund. All refund requests must be submitted in writing to info@notaryhelper.com with the subject line “Refund Request,” including your full name, account email address, transaction ID, date of payment, and a brief description of the reason for the request. Notary Helper reserves the right to request supporting documentation before approving any refund.
20.5 Notary Fees. Fees paid directly to Notaries for their professional services are governed solely by the agreement between you and the relevant Notary. Notary Helper bears no responsibility for, and will not process refunds in relation to, fees paid to third-party Notaries.
20.6 Refund Processing. Approved refunds will be processed within 10 business days of written approval and will be returned to the original payment method used at the time of the transaction. Notary Helper is not responsible for any delays caused by your bank or payment processor.
20.7 Statutory Rights. Nothing in this Refund Policy limits or excludes any statutory rights you may have under applicable consumer protection laws. EU-based consumers retain all rights afforded to them under applicable EU consumer protection directives and regulations, including any applicable right of withdrawal.
